When your lawyer’s on TV arguing the finer points of a payoff to a porn star, I think you’ve already lost.

If they sue Stormy for $XX million, wouldn’t Trump have to testify? That should make for some interesting viewing.

I think this case is a win-win for Stormy. Even if the NDA is upheld and she is ordered to pay $XXX million for violating it (which I think is unlikely), she is going to make millions more from telling her story and all the associated free publicity.

But apparently Cohen’s lawyer is being kept busy by all the other investigations going on. It will be interesting to see who else comes out of the woodwork.

The Cohen lawyer was playing to his audience of FOX viewers. I watched the whole thing, and it was amazing.
I loved when he put up the extremely unflattering photo of Cohen with a “Sez who?” expression on his face.

Meh…Stormy’s attorney has been giving me many laughs with his solo bombast, which is fine, but this kind of interaction on national television between opposing counsel was ill-advised.

Is Cohen still claiming Trump knew nothing about his $130,000 payoff?

This case isn’t going to a formal trial or arbitration. The lawyers on both sides have signaled that they want to fight this out in the court of public opinion. That might be in their personal best interests, but it certainly isn’t in Trump’s best interests.

Yes, and if I was Stormy’s attorney, I’d be demanding that the deposition be video taped so any shenanigans by Trump and Cohen and their attorneys aren’t able to be hidden by the recording being nothing but a transcript. Deposition/testifying is why I think it goes nowhere. Stormy may even magically decide to walk away and shut up about it forever after another payoff.

As a retired trial attorney I am loving the Micheal Cohen Show. He is a hilarious “type”. I was hooked from “Sez who?” and “it is well established that it is impossible to rape your spouse”. The perfect Trump lawyer, stupid and bellicose.

Then Avenatti comes along and shows him how it’s done. Say little, let your opponent make an ass of himself and let the world see how foolish the opponent is. The new clown Schwartz just explodes with volume and threats to collect every penny and Avenatti just sits quietly and looks at him unconcerned.

I could watch Avenatti all day, he is a litigator. Trump is sending clowns to swim in a shark tank.

I certainly agree it’s not going to trial. The court of public opinion won’t have much influence though. The damage is that the information is out and that’s done at this point. Padding their resumes/appearance of prominence is all these goofs are really doing with the publicity blitz, although Stormy’s attorney is smart to keep it in the news so the pressure stays high. The longer people continue to talk about the information, the more likely Trump and Cohen are going to reach a point where they just want it over so the chatter will stop and they can pretend it never happened. As soon as they cut her the check, they’ll be yammering about “Stormy who?”

The case basically comes down to this:

“What’s it worth to you that I don’t take a book deal? Oh, and by the way, if you’re having trouble coming up with an amount, here are the offers I’ve received from publishers.”

Kind of funny that Cohen would draft an agreement under California law, even though he’s not licensed there. Is that practicing law without a license or just plain ol’ malpractice?

Moreover, the contract says that Trump is making agreements, warranties and representations as a material inducement to Stormy to enter the agreement Section 4.3(a). If he doesn’t sign, then…he failed to make those agreements, warranties and representations…right?

Cohen’s client has painted himself into a corner, though, with Cohen’s help. Doubt he can back down now.
